General Terms and Conditions (GTC)

1. Scope These General Terms and Conditions (GTC) apply to all contracts concluded between Ployify GmbH (hereinafter "Provider") and its customers (both B2B and B2C). The Provider offers its digital services worldwide.

2. services & products The Provider provides an app that enables users to manage their inventory. Locations can be added and assigned products in the app. Shopping lists can also be created and all content can be shared with other contacts. This is a purely digital product.

3. prices & payment

• The app is used as part of a subscription model.

• There is a free version of the app that can be used with advertising.

• Users can choose the paid subscriptions ‘Premium Food Saver’ and ‘Family Storage’.

• The subscription fees are payable monthly or annually.

• Payment can be made directly in the app via PayPal, Google Pay, Apple Pay or credit card.

4. delivery & activation

• As this is a digital product, there is no physical delivery. The app will be activated directly after registration and, if applicable, after payment has been made.

• There are no delivery times or restrictions.

5. right of cancellation & return

• A right of cancellation is excluded as this is a digital product that can be used immediately after registration or payment.

• A return or refund is not possible.

6. liability & warranty

• The provider makes the app available in its current version and endeavours to ensure trouble-free use.

• However, the provider does not guarantee uninterrupted or error-free availability of the app at all times.

• Any liability of the provider is excluded to the extent permitted by law. This applies in particular to

  • Loss of data or damage caused by improper use of the app,

  • errors or failures of the app,

  • financial or material damage caused by incorrect or incomplete inventory management,

  • damage caused by unauthorised access to user accounts by third parties.

• Liability of the provider for simple negligence is excluded insofar as no essential contractual obligations are violated.

• Liability for intent, gross negligence or mandatory statutory liability (e.g. product liability) remains unaffected.

7. data protection

• The handling of personal data is regulated in the privacy policy.

8. final provisions

• Applicable law: Austria

• Place of jurisdiction: Vienna

• Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected.
